Australia Interdependency Visa (Subclass 310/110)

The Australia Interdependency Visa is for same sex partners, of which are in an interdependent relationship with an Australian citizen, permanent resident or eligible New Zealand citizen. You should apply for the Australia Spouse/Defacto Visa if you are married/in a defacto relationship with an opposite sex partner.

The Australia Interdependency Visa is ONLY available for same sex partners. If you have lawfully married your partner in another country, you cannot include your same sex partner as a family member on the visa application. Australian law states only opposite sex relationships constitute a spouse relationship. You should apply for the Australia Spouse/Defacto Visa if you are married/in a defacto relationship with an opposite sex partner.

To apply for an Australia Interdependency Visa (Subclass 310-110):

  • You are in an interdependent relationship with an Australian citizen/permanent resident/eligible New Zealand citizen.
  • You must be over 18 years old.
  • You must be of the same sex.
  • Be sponsored by an eligible person.
  • Meet the Australian Immigrations health and character prerequisites.
  • Show that you and your partner live together and have a mutual dedication to a shared life together.
  • Your relationship with your partner is genuine.
  • Been in an interdependent relationship for 12 months prior to the application for the visa.
  • Not to be in a prohibited degree of relationship (i.e. a relationship between his/her ancestor/descendant, parent and a child or grandparent and grandchild, or between brother and sister whether full or half blood –natural or adoptive).

Factors considered in assessing a 12 month relationship for an Australia Interdependency Visa:

  • Financial parts of your relationship -Joint real estate, bank accounts, and assets.
  • Knowledge of each other’s personal circumstances and memberships of organizations such as gym.
  • Household parts of your relationship - Living arrangements, joint household accounts and joint residential receipts.
  • Statutory declarations provided by your parents, family and friends on your relationship.
  • Joint travel arrangements.

  • How do I apply for an Australia Interdependency Visa?
  • It is a 2 stage process – you apply for both the temporary and permanent visa at the same time. If you are granted a temporary visa it is then valid until the decision is made on the permanent visa (this is usually 2 years after applying for the visa). Both visas are subject to meeting all the legal requirements.
  • Will it take 2 years until my permanent residency is granted?
  • Yes - it usually takes 2 years from your application date for permanent residency to be granted. If you have been in an interdependent relationship for 5 years + before application, then you may be granted permanent residency before 2 years.
