Prospective Marriage/Fiancé Visa (Subclass 300)

The Prospective Marriage / Fiancé Visa enables unmarried partners of an Australian citizen/permanent Australian resident /eligible New Zealand citizen to get married in and migrate to Australia. It is a temporary Visa and is valid for 9 months once the Visa is granted.

Eligibility for Prospective Marriage / Fiancé Visa:

  • You must apply for this Visa outside of Australia.
  • You must be sponsored by an eligible person (fiancé).
  • Once granted you must enter and marry your fiancé in Australia within 9 months.
  • Aged 18 + (over 16 years old if you have an Australian court order stating your proposed marriage of intended fiancé).
  • Be of an opposite sex to you partner.
  • You know your fiancé in person and have met as adults.
  • Your marriage must be accepted under Australian law. You must both be free to marry and are both of a marriageable age.
  • You must genuinely intend marry and to live with your fiancé as husband and wife.
  • Meet all health and character requirements set by Australian Immigration.

  • As adults you must have met your sponsor in person (fiancé) and be known to each other with the intention to marry.
  • If we decide to get married before the Prospective Marriage / Fiancé Visa is granted, what happens next?
  • You would now need to apply for an Australian Spouse Visa as your application for the Prospective Marriage / Fiancé Visa is no longer applicable. You would need to write to the department office that are processing your Visa and request that they change your application for the Australian Spouse Visa and withdraw the Prospective Marriage / Fiancé Visa application. A certified copy of your marriage from the marriage register must be provided to the Visa department.
  • Do we have to get married in Australia?
  • You need to visit Australia at least once on the Prospective Marriage / Fiancé Visa before you marry your fiancé, although you don’t necessarily need to marry in Australia. Failure to not enter Australia before you marry may result in the Visa being cancelled. If you do get married outside of Australia then the marriage must be recognised to fulfill the requirements set by the Australian Marriage Act 1961.
  • My fiancé doesn’t live in Australia, can he still sponsor me?
  • He can be outside of Australia at the time of application, but must meet all other requirements set for the Prospective Marriage / Fiancé Visa.
